1. Allowed Names
You may buy your own or anyone else's name (1, 2 or 3 words and no more than 50 characters) to display on 999NamesToKnow.com as long as the name is not that of an infamous character from history or current events (eg., Adolf Hitler, Usama Bin Laden, etc.) and is not the name a fictious character protected by an active copyright (eg., Homer Simpson, James T. Kirk, etc.).
You may not buy a name if it already appears on 999NamesToKnow.com. However, you may buy the name with an alternate spelling or with a middle name or initial added.
Words that are not names will not be allowed unless they are part of your legal name (eg., Moon Unit Zappa would be allowed, Best Marketing Ebook would not). Exceptions will be considered for nicknames as long as the non-name word is part of a 2 or 3 word name that includes real names.
2. Allowed Content
The website URL you submit along with your name link will be reviewed for content before your name link is approved for display on 999NamesToKnow.com.
Links to the following types of websites are not allowed: warez sites; pornography sites; illegal sites or sites that promote illegal activities; sites promoting hate or violence; sites promoting discrimination against any individual, group or organization; sites criticizing, defaming or slandering any individual, group or organization; sites that are otherwise deemed by us to be offensive or inappropriate.
If you buy a name other than your own, then you must use it to promote your affiliate link to one of that person's online businesses (if applicable).
3. Data And Content Changes
We do not permit changes to name link requests once they are submitted. It is your responsibility to review your name link request and correct spelling and/or typographical errors BEFORE you submit it to us for approval.
If at any time we find that the content of your site has changed and no longer meets our standards, your name and link will be removed from 999NamesToKnow.com and your signup fee will not be refunded.
4. Affiliate Commissions
As a paid member of 999NamesToKnow.com, you will be eligible to earn commissions by referring new paid members to the site. Once your name link has been approved, you will be issued an affiliate URL by email that you can use to refer visitors to 999NamesToKnow.com. For each sale of a name link to a visitor who you refer, you will earn 50% of the fee paid by that visitor.
Commissions are paid every Saturday to your PayPal account for non-refunded sales completed prior to the commission payment date. The minimum payout amount is USD$50.00.
You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict this statement.
5. Unsolicited Commercial E-mail or SPAM
999NamesToKnow.com in no way participates in mass unsolicited emailing (i.e. spamming). All customers and affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this Agreement and the immediate removal of your name link from the site with no refund. You will also be dismissed from our affiliate program and forfeit any unpaid commission earnings. Bottom line: If you spam, you're out!
999NamesToKnow.com considers spamming to be any activity whereby you directly or indirectly transmit email messages to any email address that has not solicited such email and does not consent to such transmission. We also consider spamming to constitute posting advertisements in newsgroups in violation of the terms of participation in such newsgroup, that are off topic, or in newsgroups that do not specifically permit advertisements. We also consider it spamming when advertisements are placed on message boards or in chat rooms when they are not permitted by the terms of participation in such message boards and chat rooms.
6. Disclaimers
You understand and agree that the purchase of a name link on 999NamesToKnow.com does not guarantee you more or any traffic to your website.
You understand and agree that the purchase of a name link on 999NamesToKnow.com does not guarantee you more or any income from your online marketing efforts or from any other source.
You understand and agree that the purchase of a name link on 999NamesToKnow.com does not guarantee you better or any placement in search engine rankings.
You understand and agree that the appearance of any person's name on 999NamesToKnow.com does not constitute an endorsement of 999NamesToKnow.com by that person.
You understand and agree that the presence of a link on 999NamesToKnow.com to any other website does not constitute an endorsement of that site by 999NamesToKnow.com.
7. No "Up-Time" Guarantee
While we will take all reasonable steps necessary to ensure that the 999NamesToKnow.com website remains online and accessible, we make no guarantee that it will be online and accessible 100% of the time or that any fixed percentage of up-time will be maintained over time.
We make no representation that the operation of our site or your Affiliate links will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.
8. Limitation Of Liability
Dan Moran, SuccessBuy.com and 999NamesToKnow.com will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement will not exceed the total of any fees or commissions paid or payable to you under to this Agreement.
You agree to defend, indemnify and hold harmless Dan Moran, SuccessBuy.com, 999NamesToKnow.com, and all its sponsors, associates, successors and assigns from any and all claims for damages arising from or related to your purchase and use of a name link on 999NamesToKnow.com.
9. Purchase Agreement
As the purchaser of a name link on 999NamesToKnow.com, you understand and agree to all the stipulations and restrictions above.
All purchases of name links on 999NamesToKnow.com are final and we reserve the right to reject any name link request for any reason without refund of fees paid. However, we reserve the right to issue refunds on a case-by-case basis for rejected name link submissions.
You acknowledge that 999NamesToKnow.com may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreemenet on the site. You agree to review the agreement periodically to be aware of such modifications, and your continued access or use of the site shall be deemed your conclusive acceptance of the modified agreement.
